Yes, the Physical Body Determines Gender — It Is Simply the Brain, Not the Sexual Organs
The Legislative Misinterpretation in Texas SB 14 (Tex. Health & Safety Code § 161.703): The legislature’s error is not the premise that the physical body determines a person’s gender. Yes, the physical body does determine a person’s gender—it is simply the wrong part of the physical body that they assumed determines gender. It is not the sexual organs; it is the physical brain.
Clinical & Statutory Data (Exhibit 9b · PMID: 19403051 · NBK1429): In Partial Androgen Insensitivity Syndrome (PAIS), partial resistance of Xq12 Androgen Receptors (AR) elevates pituitary FSH to 18.7 mIU/mL [High] and unmedicated Total Testosterone to 1,112 ng/dL [High], while aromatase (CYP19A1) converts excess testosterone into Estradiol (42 pg/mL [High]) that binds intact central Estrogen Receptors (ERα/ERβ). Meanwhile, Tex. Health & Safety Code § 161.703(a)(2)(A)(ii) explicitly exempts 46,XY chromosomes with undervirilization in peripheral sexual organs while ignoring the central nervous system.
The Accelerator Pedal, The Engine (BSTc), and Flashing the Brain’s ECU ROM: Just as an accelerator pedal does not make a car or truck go faster—it is simply a mechanical receiver that transmits a physical signal to the engine, and it is all the components of the engine that give a truck its fire—a sexual organ is not what makes us feel male or female. Sexual organs also just transmit a signal to the bed nucleus of the stria terminalis (BSTc) of the brain, which tells a person what gender they are.
And just like the control software of the Electronic Control Unit (ECU) does not get downloaded into the truck at the same time the steel frame is made, the brain does not get the download of testosterone at the same time the external frame is built (Weeks 6–12). That prenatal download happens in the second half of pregnancy (Weeks 14–24) and is a major determinant of what gender a person feels they are—linked directly to the actual physical “etching” that testosterone performs in the brain, the exact same way ROM on a car’s ECU is flashed.

A sexual organ does not experience gender. The brain does.
A man who loses his sexual organ does not lose his male identity. The sexual organ was never the organ producing that identity. The brain was.
Every gender experience is subjective because it is experienced from inside a person. Every gender experience is physical because a physical brain produces it.
“In your head” means in your brain—the physical organ that produces consciousness, memory, pain, body perception, and a sense of self.
